NAFR HIGH COURT OF CHHATTISGARH, BILASPUR MCC No. 622 of 2016 Yogeshwar Dewangan Son of Shyamlal Dewangan, aged about 30 years, resident Durga Chowk, Rajnandgaon, Tahsil and District Rajnandgaon (C.G.) ---- Applicant

Versus

Sushil Kumar Bajpayee Son of Late Mahaveer Prasad Bajpayee, aged about 50 years, resident Gudakhu Line, Rajnandgaon, Tahsil and District Rajnandgaon (C.G.) ---- Respondent For Applicant :- Mr. Goutam Khetrapal, Advocate For Respondent/ State :- Mr. Parag Kotecha, Advocate Hon'ble Shri Justice Goutam Bhaduri Order On Board 29/08/2016 1.

Heard on MCC for extension of time for vacating the suit premises. 2.

Earlier by order the dated 31.03.2016, four months time was given to vacate the premises. Subsequently, another application was filed and by order dated 29.07.2016, the applicant was given further one month time to vacate the premises and now again the petition is filed for extension of time and prayer is made that the applicant may be given further two weeks time to vacate the premises.

3.

Shri Parag Kotecha, learned counsel for the respondent opposes the prayer for extension of time.

4.

Considering the fact that already earlier on two occasions, i.e. on 31.03.2016, four months time was granted and on 29.07.2016 instead of prayer of 45 days, 30 days time was granted to the applicant to vacate the premises, I am not inclined to allow the instant MCC for extension of further time.

5.

Accordingly, the instant MCC is dismissed.
