Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 31/08/2016 The transfer order is under challenge on the ground that the petitioner has never applied for transfer yet he is transferred showing it to be on his own request. 2.

It is either a mistake or an act of mischief. The allegations are serious and requires proper enquiry by the transferring authority. Let enquiry be conducted by the respondent / State through responsible officers into the allegations that the petitioner never made application for transfer. The enquiry shall be completed within a period of four weeks. Depending upon the result of enquiry, appropriate order shall be passed.

For a period of four weeks, no coercive steps shall be taken against the

petitioner and the petitioner shall be allowed to continue at the present place of posting.
