The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 103/2015 registered in Police Station Saja, District Bemetara (C.G.) for offence punishable under section 306, 34 of IPC.

As per the prosecution case, applicant along with four other coaccused persons instigated Laxmi Bai to commit suicide and thereby she committed suicide on 17/10/2014 3.

Learned counsel for the applicant submits that quarrel took place in between wife of the applicant who came back from matrimonial house along with the deceased Laxmi Bai who started living with the applicant and because of such dispute Laxmi Bai committed suicide on 17/10/2014. Learned counsel submits that charge sheet has been filed and the similarly placed co-accused have been enlarged on bail in M.Cr.C. Nos.

3744/2015 and 4299/2015.

Learned State counsel opposes the prayer for grant of bail, however do not dispute the fact that similarly placed co-accused persons have been enlarged on bail in M.Cr.C. Nos. 3744/2015 and 4299/2015. 5.

Taking into account nature and gravity of the offence and also for the fact that similarly placed co-accused persons have been enlarged on bail in M.Cr.C. Nos. 3744/2015 and 4299/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
