20.12.2021 Heard on application for grant of leave to appeal under Section 378 (3) of Code of Criminal Procedure, 1973 It is submitted by the counsel for the appellant that the prosecutrix (PW-1) has fully supported the case of prosecution, even then the learned counsel disbelieved her version. Hence, he may be granted liberty to file acquittal appeal.

After considering on the submission, we are of the considered opinion that it is a fit case in which the application should be allowed and hence, the application is allowed and leave is granted to file acquittal appeal under Section 378 (3) of Cr.P.C.

Let the appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.

CRMP is accordingly disposed off.
