At the very outset, learned State counsel submits that the challenge in this petition to the advertisement dated 24.12.2009 has already been canceled. 2.

Learned counsel for the petitioner submits that the letter dated 21.07.2014 filed as Annexure R-1 with the affidavit of the State cannot be done as it was done during the pendency of this petition. He prays for amendment in the petition.

Reading of the amendment and the grounds raised therein would show that separate grounds have been prayed to be incorporated which can always be subject of a separate writ petition. Challenge in the instant writ petition is to the advertisement dated 24.12.2009 and according to the affidavit of the

State, the advertisement already stands annulled and therefore, the instant writ petition has become infructuous.

In view of the same, the writ petition is dismissed as having become infructuous. However, liberty is reserved to the petitioner to challenge the grounds raised in the amendment application by way of a separate writ petition, if so advised.
