(2) This is the third bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicants, who have been arrested in connection with Crime No.57/2015 registered at Police Station Kasdol, District Baloda Bazar-Bhatapara, for the offence punishable under Sections 147, 149, 186, 353, 332, 294, 336, 395 of the Indian Penal Code.
(3) The applicants' first bail applications were dismissed as withdrawn with liberty to repeat the same after examination of all the
material prosecution witnesses by order of this Court dated 04.05.2015 passed in M.Cr.C. No.1446/2015 & M.Cr.C. No.1453/2015, respectively and the second bail applications of the applicants were also dismissed as withdrawn with liberty to repeat the same after examination of all the prosecution witnesses by order of this Court dated 11.08.2015 passed in M.Cr.C. No.4212/2015 & M.Cr.C. No.4213/2015, respectively (4) Again, the third bail application of the applicants has been filed by the applicants without examination of all the material prosecution witnesses and, as such, the third bail application cannot be entertained in view of the order dated 04.05.2015 & 11.08.2015. Consequently, the third bail application of the applicants is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible.
