1. Aggrieved by the decision taken by the respondents on 05.04.2021 Annexure P-1, the present writ petition has been filed.

2. The order under challenge is an order of punishment whereby the petitioner has been inflicted with a penalty of stoppage of two annual increment with cumulative effect.

3. During the course of hearing, it has been revealed that petitioner has already preferred a departmental appeal to the respondent no.2 against

-2the order of punishment dated 26.06.2020 and the appeal is still pending consideration before the Authorities concerned.

4. Given the fact that departmental appeal of the petitioner is already pending consideration before the respondent no.2, it would not be proper for this Court at this juncture to enter into the merits of the case. Accordingly, the writ petition at this juncture stands disposed of directing the respondent no.2 to consider and decide the appeal on its own merits in accordance with law at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.

5. Respondent no.2 is expected to decide the appeal by a speaking order considering all the contentions that the petitioner has raised in the appeal. 6.

With the aforesaid observations, the present writ petition stands disposed of.
