Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 16.07.2018

1. The petitioner has preferred this writ petition to quash order dated 07.06.2018 issued by respondent No.2 for promotion of the

private respondents i.e. respondents No. 3 to 9 for the post of Training Superintendent and to direct respondent No.2 to grant him promotion as Training Superintendent, one day before, when the juniors employees have been promoted as Training Superintendent with all consequential benefits and to decide his pending representation dated 11.06.2018 (Annexure P/5).

2. The petitioner is working as Training Officer and posted at I.T.I. Government, Magarload, District Dhamtari.

3. Counsel for the petitioner would submit that the instant writ petition may be disposed of by giving direction to respondent No.2 to decide his pending representation dated 11.06.2018 (Annexure P/5) within a stipulated time.

4. Looking to the facts and circumstances of the case and submission made by the counsel for the petitioner, the instant writ petition is disposed of with this direction that respondent No.2 shall consider and decide the pending representation of the petitioner dated 11.06.2018 (Annexure P/5) expeditiously preferably within a period of 90 days from the date of receipt of certified copy of this order, according to law and procedure and considering all consequential benefits.

5. It is made clear that this Court has not expressed any opinion on the merits of the case.
