1. The applicant has preferred this application for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.83/2020, registered at Police Station Marwahi, District Gourela-Pendra-Marwahi for offences punishable under Section 354 and 506 of the IPC.
2. The applicant has allegedly outraged the modesty of the prosecutrix aged about 30 years.
3. Learned State Counsel would read statement of the prosecutrix.
4. Considering the nature of allegation and the material available in the case diary, I am not inclined to exercise power under Section 438 of the CrPC to release the applicant on anticipatory bail. Accordingly, the Application is rejected. However, if the applicant surrenders and applies for regular bail before the jurisdictional Sessions Court under Section 439 CrPC, the same shall be considered and decided expeditiously, at the earliest.
