The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No. 446/2015 registered in Police Station Kharsiya, Distt. Raigarh (C.G.) for offence punishable under section 457, 380 of IPC.

As per the prosecution case, a theft was committed on 20/09/2015 in the shop of Naresh Agrawal and desi ghee, hair oil, cash Rs.13,000/- was stolen total amounting to Rs.25,400/-. Subsequently, cash was seized from the applicants.

Learned counsel for the applicants submits that charge sheet in this case has been filed and the applicants are in jail since 22/09/2015 and applicants have been falsely implicated in this case as no offence has been committed by them, therefore they may released on bail.

Learned State counsel opposes the prayer for grant of bail, however do not oppose the fact that charge sheet has been filed. 5.

Having regard to the facts and circumstances and gravity of the offence, charge sheet has been filed, applicants are in jail since 22/09/2015, this court is inclined to release the applicants on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
