1. The present Contempt Petition has been filed alleging noncompliance of the Order dated 29.01.2019 passed in WPS No. 594/2019.

The respondent has filed his reply and also filed additional reply, wherein it has been specifically mentioned that since the petitioner/applicant was only transferred to the Municipal Corporation, Raipur is a parent department continued to be that of the Municipal Council-Chapa (Nagar Parishad, Chapa), of which the petitioner/applicant was a substantive employee.

3. The counsel for the respondent also referred to Section 58 in this regard, wherein it has been specifically mentioned that even on

-2transfer, the lien of the petitioner/applicant would be maintained in the parent body ie, Municipal Council-Chapa in the instant case.

4. Given the said facts that, the respondent has filed reply and additional reply, this Court is of the opinion that nothing further remains to be proceeded with in the present Contempt Petition thus the same stands disposed-off and the respondent is discharged of the contempt proceedings.

5. Reserving the right of the petitioner/applicant to approach this Court by way of fresh petition for appropriate direction to the Municipal Council-Chapa for ventilating his grievance.
