The applicant has preferred this first bail application under Section 439 of the Code of Criminal Procedure for grant of bail as he is arrested on 12.09.2020 in connection with Crime No. 24/2020, registered in Police Station Excise Circle Pithora, Distt. Mahasamund (C.G.) for offence punishable under section 34(2) of Chhattisgarh Excise Act. 3.

As per the prosecution case, 50 liters of liquor was seized from the possession of the applicant on 12.09.2020.

Learned counsel for the applicant submits that the applicant, at present, is out of parole and the chargesheet is also filed, no further investigation is necessary therefore he may be enlarged on bail.

Learned State counsel submits that the applicant has four cases to his credit of the like nature as against which learned counsel for submits that the applicant has been acquitted in two of the cases. 6.

Considering the submission made and the fact that the chargesheet has been filed, I am inclined to release the applicant on bail. Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. 7.
