Hon'ble Shri Justice Gautam Chourdiya Order on Board 22/09/2021 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 25/07/2020 in connection with Crime No. 131/2020 registered at Police Station Ambagarh Chowki, District Rajnandgaon (C.G.) for the offence punishable under Section 420, 120-B/34 of the Indian Penal Code and 66-C, 66-D, 72 of Information of Technology Act. 2) Learned Counsel for the applicant does not want to press this application and seeks to withdraw the same with liberty to repeat his prayer for bail, if the trial is not concluded within a period of nine months from today.

3) Accordingly, the application is dismissed as withdrawn with aforesaid liberty. The Trial Court is directed to expedite the trial and conclude the same as early as possible.
