1. Heard.

2. This is the second application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.40/2020 registered at Police Station Sahaspur Lohara, District Kabirdham (CG) for the offence punishable under Sections 420, 34 of the IPC.

3. The applicant along with co-accused Kapileshwar Puri Goswami have extracted hefty amount of Rs.77 lakhs from different

MCRC No. 7227 of 2020 victims on false assurance of arranging Government jobs for them.

4. The first bail application of the present applicant bearing MCRC No.2529 of 2020 and that of co-accused Kapileshwar Puri Goswami bearing MCRC No.2528 of 2020, were rejected by this Court vide a common order dated 13.8.2020. Thereafter, the second bail application bearing MCRC No.6827 of 2020 preferred by co-accused Kapileshwar Puri Goswami has also been dismissed on 8.12.2020.

While dismissing the first bail application of the applicant, it is specifically observed that applicant Navin Tiwari also used to approach the victims on behalf of Kapileshar Puri Goswarmi, fraudulently assuring them of arranging employment, if the amount is paid by them. Thus, the earlier bail application was dismissed on merits.

6. Considering the nature of allegations against the applicant and there being no change in the circumstance, this Court is not inclined to release the applicant on regular bail.
