This is the second Application filed under Section 439 of Cr.P.C. for grant of bail to the Applicant who is in jail since 30.6.2015 in connection with Crime No. 80/2015 registered at Police Chowki Bundeli, Police Station Tendukona, District Mahasamund, for the offence punishable under Section 20 (b) of the N.D.P.S. Act. 2.

The first Bail Application filed by the Applicant stood dismissed as withdrawn vide order dated 24.7.2015 passed by this Court in M.Cr.C. No. 3660/2015.

Allegation against the Applicant is that he was carrying 1100 gram of Ganja on his bicycle on 30.6.1015.

Having heard the Counsel for the parties and taking into consideration the total facts and circumstances of the case, this Court is of the opinion that it is not a fit case where the Applicant can be released on bail.

The application filed under Section 439 Cr.P.C. stands accordingly rejected.
