This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.382/2013, registered at Police Station - Bhilai Nagar, District Durg (C.G.) for the offence punishable under Section 420 of Indian Penal Code. 2.
Case of the prosecution, in brief, is that the applicant was running Chhattisgarh Dainik Pahat Agency office had obtained money from Bharesh Kumar, Chandra Prakash, Shankar Lal and Jaswant Kumar Rawate to provide them job in NMDC, Kirandul and thereafter, could not provide the job as such has committed forgery. 3.
Learned counsel for the applicant would submit that Bharesh Kumar and Chandra Prakash were working in the office of the applicant itself,
Page No.2 wherein as per allegation in the year 2006, some amount was obtained from the Bharesh to get the job in NMDC, Kirandul and thereafter, in the year 2009, Chandra Prakash and Shankar Lal has also paid amount to the applicant, however, the job was not provided. Learned counsel for the applicant further submits that it is the probable story of the prosecution. He would further submit that the charge sheet has been filed and the applicant is in jail since 17.07.2015, therefore, he prays that the applicant may be enlarged on bail. 4.
On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel appearing for the parties and perused the case diary.

Having regard to nature of the allegation and the fact that the charge sheet has been filed and the applicant is in jail since 17.07.2015, this Court is of the opinion that present is a fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
