This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.89/2005, registered at Police Station- Moudahapara, Raipur (C.G.) for the offence punishable under Section 147, 148, 302/149, 302/120-B of Indian Penal Code and Section 25, 27 Arms Act.

Learned counsel for the applicant submits that the trial is going on but there is no substantial progress in the trial and therefore considering the fact that the delay being caused, the applicant may be enlarged on bail, as he is in jail since the year 2013. 3.
Per contra, learned State counsel opposes the prayer for grant of bail and he would submit that all the witnesses have been examined and only two witnesses are still to be examined for which the trial is already fixed for 2nd & 4th January, 2016.

Considering the statement made by the State counsel that the trial is on the verge of completion, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
