The applicant has filed this application under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail, in connection with Crime No.488/2017 registered at Police Station : Civil Lines, Raipur (C.G.) for the offence punishable under Section 420/34 of IPC. 2.
As per the prosecution case, the Manager of ICICI Bank lodged a report that two credit cards have been issued in the name of Krishlal Ravi and Smt. Kalyani Ravi, who made a complaint in the Bank that no credit card were issued in their favour however, funds have been debited from their account. The Bank made an internal enquiry and found that two credit cards were issued in their name however, some of the documents were interpolated and those credit cards were not delivered to those persons. It was further found that one Jitesh, who
was dealing with the issuance of credit card, was involved in the matter. The present applicant is also one of the aide of Jitesh. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the crime in question. Applicant is innocent and has no connection with the alleged crime. He also submits that the applicant is neither an employee of the Bank nor has any connection in issuance of delivery of said credit cards. As per the case diary, the forged credit cards were issued by the Bank and the person involved was an employee of the Bank. He further submits that the allegation of involvement of the applicant is merely on the basis of some photographs uploaded in Instagram by the accused. Therefore, he may be released on bail.

On the other hand, State counsel opposes the bail application and submits that there are sufficient evidence against applicant in case diary that he has intentionally submitted forged documents before bank for issuing credit card.

I have heard learned counsel for the parties and perused the record. 6.
Considering the totality of the facts and circumstances of the case, in particular the case-diary, at this stage, I am not inclined to allow the anticipatory bail of the applicant.

Accordingly, his application filed under Section 438 of the Code of Criminal Procedure is rejected.

Hon'ble Smt. Justice Rajani Dubey Order On Board 28/08/2019 This is an ofÏce reference seeking modification in the order dated 08.08.2018 passed by this Court in MCRCA No.1084/2019.
In the order dated 08.08.2018 passed in MCRCA No.1084/2019 there appears to be a typographical mistake relating to the order date.
From perusal of the record, it appears that in the order passed in MCRCA No.1084/2019 the date has wrongly been typed as 08.08.2018 in place of 08.08.2019. Thus, the error is apparent on the face of the record which needs to be rectified.
Accordingly, it is ordered that the date of order in question be read as 08.08.2019 instead of 08.08.2018. With the modification as aforesaid, ofÏce reference stands disposed of.
