1. The grievance of the petitioner which led to filing of the instant petition relates to non-finalization of his retiral dues.

2. The main operative reason for non-finalization of petitioner's case was an enquiry pending on account of alleged unauthorized absence of the petitioner from 5.2.2002 to 31.3.2013 i.e. till his attaining the age of superannuation.

However, in the return, it has now been disclosed that an order has been passed giving appropriate treatment to the period of anuthorized absence as dies non vide order dated 6.5.2017 and the proceedings for finalization of petitioner pension case have been speeded up by issuing memo dated 13.6.2017 by the Commissioner, Bilaspur Division to Joint Director, Accounts Treasury and Pension, Bilaspur and it is expected that pension case of the petitioner would be finalized soon.

4. Taking into consideration the totality of the circumstances of the case, I am of

-2the view that at this stage it would be appropriate to dispose off the matter with a direction that the pension case of the petitioner shall be finalized by the respondents at the earliest, within an outer limit of 3 months and the dues which are found payable to the petitioner shall be released forthwith. The Joint Director, Accounts Treasury and Pension, Bilaspur shall be under an obligation, in coordination with the office from which the petitioner retired, to ensure that all the retiral benefits are paid to the petitioner within the time stipulated by the Court.
