Hon'ble Shri Justice P. Sam Koshy Order on Board 06/10/2020 1.

The present writ petition has been filed seeking for a direction to the respondents to remove the illegal encroachment and construction made by the respondents No. 5 & 6 on the government land.

2.

According to the petitioner, the respondent No.3 has already passed an order as early as on 15.02.2016, but till date it has not been acted upon, nor has the respondent No.5 & 6 taken any decision for removing the illegal encroachment.

3.

Given the fact that it is a matter pertaining to encroachment of government land, this Court is of the opinion that the writ petition at this juncture can be disposed of directing the petitioner to appear before the respondent No.2 to 4 by moving a fresh representation, which the respondents No.2 to 4 shall consider and take an appropriate decision in accordance with law keeping in view the earlier order of the respondent No.3 dated 15.02.2016, which by now has attained finality. Let a decision be taken in this regard at the earliest.

With the aforesaid observations, the present writ petition stands disposed of.
