Hon'ble Justice Shri Gautam Chourdiya Order on Board 15/11/2021 1) This is the Second Bail Application filed under Section 439 of Code of Criminal Procedure, 1973 for grant of bail. The First Bail Application i.e. MCRC 972/2021 was dismissed on merits on 19/03/2021.The applicant is arrested on 06/07/2020 in connection with Crime No. 183/2020 registered at Police Station Kanker, District Kanker (C.G.) for the offence under Sections 302 & 201 of Indian Penal Code.

2) Counsel for the applicant was granted number of opportunities on earlier occasions to remove the default, but, till date the same could not be removed.

3) Today, also the matter was passed over once for want of any representation on behalf of the applicant. No one appears for the applicant even in the second round.

4) In these circumstances, there is no other option left with the Court, but to dismiss the MCRC for want of prosecution.

5) Accordingly, the instant MCRC is dismissed for want of prosecution.
