1. Heard.
2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.113/2020 registered at Police Station Janakpur, District Koria (CG) for the offence punishable under Section 21(C) of the Narcotics Drugs Psychotropic Substances Act.
3. Four persons namely Ajay Singh Baghel, Ankit Sharma, Nishant Kumar Singh and the present applicant Satyam Dhar Sharma were travelling in two motorcycles. They were intercepted by the concerned Police and on checking, Ajay Singh Baghel was
found in possession of 16 bottles each containing 100 ml of Wincireks Cough Syrup containing Psychotropic Substance Codeine. Co-accused Ankit Sharma was also found in possession of 5 bottles of cough syrup, whereas, the present applicant and co-accused Nishant Kumar Singh were not found to be having any cough syrup with them.
4. Admittedly, co-accused Ankit Sharma has already been granted regular bail by a Coordinate Bench of this Court in MCRC No.6888/2020 vide order dated 6.11.2020 read with corrected order dated 10.11.2020.
5. Since this applicant was not found to be carrying cough syrup with him, but has been arrested as he was moving along with the persons who were found to be carrying cough syrup and the applicant is in jail since 16.8.2020, this Court is inclined to release the applicant on regular bail.
6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
