NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 331 of 2017 Shashi Bhushan Say S/o Shri Dheeran Say, Aged About 56 Years Assistant Grade II, Office Of Sub Divisional Officer, Dharamjaigarh, District Raigarh (Chhattisgarh) ---- Petitioner
Versus
1. State Of Chhattisgarh Through: The Secretary, Department Of Revenue, Mahanadi Bhawan, Naya Raipur (Chhattisgarh)
2. Deputy Secretary, Department Of Revenue, Disaster Management, Mahanadi Bhawan, Naya Raipur (Chhattisgarh)
3. The Collector, District Raigarh (Chhattisgarh) ---- Respondents Shri Ashok Shukla, counsel for the petitioner/s. Shri R.K.Gupta, Dy.G.A. for the State.
Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 20/01/2017 The transfer order dated 21/07/2016 has been challenged by the petitioner at this distance of time after almost six months stating that in the matter of transfer, approval of the concerning Minister has not been taken. The other ground is that the father of the petitioner is aged 75 years and suffering from paralysis. Therefore, transfer from Dharamjaigarh to Kharsiya would adversely affect him. 2.
The transfer order has been challenged after almost six months. It is found that the petitioner has been transferred to a place which is hardly 70 kms. from the present place of posting. The ground of hardship raised by the petitioner is not such as to warrant interference by this Court, particularly, when the petitioner himself did not choose to challenge the transfer order for almost six months. 3.
The petition is accordingly dismissed with liberty to prefer representation. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
