Hon'ble Shri Justice P. Sam Koshy Order on Board 21/02/2017 1.

The present writ petition has been preferred for issuance of an appropriate direction to the Respondent-SECL for correction of their records in respect of the land which has been acquired at Village Suwabhondi, Tahsil Haradi Bazar, Korba, for the purpose of mining and the list vide Annexure P-4. 2.

Counsel for the Petitioner submits that it is a case where the total land which has been acquired of the Petitioner was 0.59 acres and as per the list which has been prepared by the Respondent-SECL the name of the Petitioner has been reflected at Sl. No.98 showing that the land which has been acquired belonging to the Petitioner was only 0.19 acres and if the said correction is made, the name of the Petitioner would be placed at Sl. No. 37 just below the person whose name appears at Sl. No.36 whose land acquired was 0.62 acres and this would accelerate the grant of employment to the Petitioner.

-23.

Counsel for the Respondent-SECL at this juncture submits that the petition may be disposed of with a direction to Respondent No.2 to verify the factual aspects so far as the total area of land which has been acquired belonging to the Petitioner at Village Suwabhondi and in case, if any rectification is required the same may be carried out. 4.

Submission of the Counsel for the Respondent-SECL seems to be fair and reasonable.

5.

Accordingly, the present writ petition is disposed of, with a specific direction to Respondent No.2 to personally look into the grievance of the Petitioner and to ascertain the total area of land which has been acquired of the Petitioner at Village Suwabhondi and thereafter in case, if any rectification is required the same may be done within a period of 90 days from the date of production of certified copy of this order by the Petitioner before Respondent No.2. In case, if the Respondent-SECL finds that that there is no rectification required to be done, the same may be suitably informed to the Petitioner showing reasons for the same.

6.

The present writ petition stands accordingly finally disposed of with the aforesaid direction.
