NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CONT No. 24 of 2017 Mukesh Kumar Kesharwani S/o Pusuram, Aged About 32 Years R/o Manjhapara, Distt. Uttar Bastar Kanker, Chhattisgarh ---- Petitioner
Versus
1. Shami Abidi The Collector, Distt. U.B.Kanker, Chhattisgarh
2. Jagjeevanlal Uike, Chief Medical And Health Officer, District U.B.Kanker, Chhattisgarh ---- Respondents For Petitioner :
Mr. Parag Kotecha, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 17/01/2017 Heard 1.
Learned counsel for the petitioner alleges willful disobedience of order dated 24.08.2016 passed in WPS No.162 of 2016 by submitting that even though this Court observed that as no interim orders passed by this Court in pending Writ Petition No.3753/2014, the respondents may take appropriate decision in the matter and reach to the logical conclusion, no decision has been taken nor the orders have been passed.
2.
This Court did not issue any direction to declare the result taking into consideration that the appointments are already under challenge in pending writ petition, it was only clarification that if there is no interim order, the respondents may take appropriate decision. Therefore it is not a case of contempt and the contempt petition is therefore dismissed. Sd/- (Manindra Mohan Shrivastava) Judge Rekha
