The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No. 277/2015 registered in Police Station Abhanpur (C.G.) for offence punishable under Section 34 (2) of Chhattisgarh Excise Act.

As per the prosecution case, on raid being made on 8/10/2015 from the possession of the applicant 5.760 bulk liters of liquor was seized and thereby offence is committed.

Learned counsel for the applicant submits that considering the quantity of liquor seized and the detention that applicant is in jail since 9/10/2015, she may be released on bail.

Learned State counsel opposes the prayer for grant of bail and submits that Crime No.214/2014 and 36/2015 for offence under the Excise

Act were registered against the applicant, therefore he may not be enlarged on bail.

Having considered the case diary and the fact that two cases under the Excise Act were registered that too in the year 2014-2015 and it is not necessary that after his release on bail same offence again will not be committed. Therefore, considering the nature of offence, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
