The applicant has preferred this first bail application under Section 439 of the Code of Criminal Procedure for grant of bail as he is arrested on 27.06.2020 in connection with Crime No. 15/2020, registered in Police Station Ranitarai, District Durg (C.G.) for offence punishable under sections 498-A, 306 of the IPC.

As per the prosecution case, the applicant was married with the deceased on 14.05.2014 thereafter she committed suicide on 12.10.2019 by hanging herself with the allegation that the applicant has demanded two mobile phones, cash and also she was subjected to cruelty for demand of dowry, eventually she committed suicide. 3.

Learned counsel for the applicant submits that the suicide note

thereafter was seized by the police do not clamp any allegation of abetment, no evidence exists and no case is made out. He further submits that the chargesheet has also been filed. 4.

Learned State counsel opposes the argument made by learned counsel for the applicant.

Considering the facts and after reading the suicide note, without any further observation, I am inclined to release the applicant on bail. Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
