Mr. Neeraj Jain, Govt. Advocate, for the State. This is an application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection with Crime No. 89 of 2015 registered at P.S. Pithora, District Mahasamund (C.G) for the offence punishable u/s 20(B)(II) (B) of Narcotic Drugs and Psychotropic Substances Act.

As per the prosecution story, on a raid being conducted by the police, the applicant was found to be carrying 6 Kgs. of Cannabis and thereafter the seizure having been made, the applicant was arrested and the charge sheet was filed.

Learned counsel for the applicant submits that the applicant is in jail since 26.05.2015 and more than 6 months have elapsed and therefore looking to the period of custody, the applicant may be enlarged on bail.

Per contra, learned State Counsel opposes the bail. Having regard to the quantity of contraband Ganja alleged to have been seized from the applicant and the period of detention, I am not inclined to release the applicant on bail at this stage.
