Heard on I.A. No. 1/2017, which is an application for condonation of delay.

For the reasons assigned in the said application and the same found to be satisfactory, in addition the delay in filing the present M.C.C. is only 6 days, this Court is of the opinion that present is a fit case for the delay to be condoned.

Accordingly, I.A. No. 1 is allowed. The Delay of 6 days in filing the M.C.C. stands condoned.

The present M.C.C. has been preferred seeking restoration of W.P.(C) No. 3448/2007 which was dismissed for want of prosecution on 24.11.2016. For the reasons assigned in the M.C.C. and same found to be satisfactory, the M.C.C. is allowed. The Writ Petition, W.P.(C) No. 3448/2007 is restored to its original number.

The said petition be listed for final hearing in the week commencing 30th January, 2017.
