The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 351/2015 registered in Police Station Civil Lines, Bilaspur (C.G.) for offence punishable under Section 457, 380, 411 of IPC.

As per the prosecution case, on 8/07/2015 theft occurred in Hari bhoomi Press and it was found that certain spare parts, ceiling fan, electric wire have been stolen and thereafter matter was investigated and the applicant was arrested and on his memorandum certain goods were recovered from the purchaser Santulal.

Learned counsel for the applicant submits that no seizure has been made from the applicant and even goods which were stated to have been stolen have not been recovered from the so called purchaser and

therefore applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail and submits that purchaser of the goods Santulal bail application has been dismissed by the coordinate bench of this court in M.Cr.C. No.5974/15 on 5/10/15.

Having regard to the fact that bail application of the co-accused has been dismissed, this court is not inclined to release the applicant on bail. 6.

Accordingly, the bail application is dismissed. However, trial court is directed to expedite the trial and conclude the same within further period of six months.
