2017-01-30Hon'Ble Shri Justice Manindra Mohan Shrivastava2 pages

NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No.261 of 2017 • Chandra Prakash Sharma S/o Late Shri K. N. Sharma, Aged About 51 Years R/o Gypsy 27, Ganpati Vihar, Borsi, P. S. Pulgaon, District Durg (Chhattisgarh).

---- Petitioner

Versus

1. State Of Chhattisgarh Through : The Secretary, Women & Child Development Department, Mahanadi Bhawan, Mantralaya, New Raipur, District Raipur (Chhattisgarh).

2. The Director, Directorate Of Women And Child Development Department, New Raipur, District Raipur (Chhattisgarh).

3. Collector, Balod, District Balod (Chhattisgarh). ---- Respondents For Petitioner :

Shri T. K. Tiwari, Advocate For Respondent/State :

Shri D. R. Minz, Dy.GA Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 30/01/2017 Heard.

2.

Learned counsel for petitioner submits that the respondents have passed an order on 29-12-2016, by which, the petitioner has been transferred to Integrated Child Development Project, Bemetara. It is submitted that earlier, the petitioner was transferred vide order dated 04-02-2016 from Gunderdehi District Balod to Bacheli, District Dantewada. This order was later on modified vide order dated 14-06-2016 and the petitioner was transferred from Gunderdehi, District Balod to Dondi, District Balod. However, now changing the posting order of the petitioner in consideration of petitioner's transfer to non-scheduled area, the petitioner has been transferred to Bemetara vide order dated 29-12-2016

which does not cancel order dated 14-06-2016 and unnecessary reference has been made to order dated 04-02-2016, which was already modified on 14-06-2016.

3.

It appears that because of frequent change of transfer of the petitioner, some kind of discrepancy crept in though the petitioner has been considered for transfer to a non-scheduled area. In these circumstances, subject to the direction to the respondents to pass appropriate corrective order with regard to posting of the petitioner, this petition is finally disposed off. The petitioner shall proceed to join at Bemetara and he shall not be subjected to any hardship on the ground that earlier he was relieved from Gunderdehi to join at Dondi under order dated 14-06-2016.
