Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 07/01/2021

1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicants, who have been arrested in connection with Crime No.301 of 2020, registered at Police Station Khamtari, District- Raipur C.G. for the offence punishable under Sections 307, 147, 148, 149 (34 not mentioned in the court order) of the IPC and

MCRC No. 7415 of 2020 Section 25, 27 of the Arms Act.

2. The applicants along with other co-accused persons formed an unlawful assembly and assaulted injured Monu Jaiswal by means of club and knife causing two incised wounds over his shoulder. It is said that two groups of truck owners/ employees including driver, conductor etc raised an altercation, in which, the injured has sustained injuries.

3. Admittedly, co-accused Prakash Dubey, Mukesh Dubey and Deepak Dubey have already been allowed regular bail by this Court vide order dated 02.11.2020 in MCRC No.6271/2020, therefore, considering the entire fact situation of the case, the present applicants deserve to be released on bail as they are also in jail since 13.07.2020, I am inclined to release the applicants on regular bail.

4. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
