Shri Shikhar Bakhtiyar, Advocate For Respondent / State :

Shri Lav Sharma, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 03/08/2018 This is 3rd bail application filed by the applicant. Taking into consideration that earlier, the bail applications were rejected on merits, I am not inclined to grant bail to the applicant. However, it is found that the applicant has remained in jail since 30/10/2016 i.e. well over one year and eight months, trial ought to be concluded at the earliest.

The Trial Court shall do well to conclude the trial at the earliest without granting unnecessary adjournment to any of the parties. If the witnesses are not appearing on summons, coercive process shall be initiated to secure presence of the witnesses. In case, trial is not concluded within a further period of three months, the applicant may revive the bail application.
