Mr. Gagan Tiwari, Dy. Govt. Advocate, for the State. This is first bail application filed u/s 439 of the Code of Criminal Procedure for the Crime No.90/2018 registered at P.S. Baikunthpur, Distt. Koriya (C.G) for the offence punishable u/s 302 of IPC. During the submission, it is stated that all the prosecution witnesses have been examined and the case is fixed for statement of accused. In view of such statement, I am not inclined to decide the case on merits as it may amount to adjudicating the case on merits and conducting the trial.
