This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who have been arrested in connection with Crime No.134/2015 registered at Police Station- Tumgaon, District Mahasamund (C.G.) for the offence punishable under Section 34(2) of the Excise Act.

The prosecution alleges that the applicant was found to be in possession of illicit liquor measuring about 14.865 bulk liters and he was arrested on 30.09.2015.

Learned counsel for the applicant submits that the applicant has falsely been implicated in this case and he is in jail since 30.09.2015; therefore, he may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. He would submit that as per the information received from the

concerned SHO, there are as many as six cases registered against the applicant under the Excise Act and out of which two cases under Section 34(A) are pending, which are out of the Crime No.125/2015 and 183/2014.

Having considered the previous antecedents of the applicant that there are as many as six cases were registered out of which three cases are still pending which is of the similar nature, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
