This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.109/2015 registered at Police Station- Lundra, District Surguja (C.G.) for the offence punishable under Section 22 of the Narcotics Drugs and Psychotropic Substance Act, 1985.

Case of the prosecution, in brief, is that on 30.09.2015 on information received, the applicant was intercepted and from his possession 6.06 grams of Brown-Sugar was recovered. Therefore, the offence has been registered and the investigation is going on. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and he is in jail since 01.10.2015; therefore, he may be enlarged on bail.

Per contra, learned State counsel opposes the prayer for grant of bail and he would submit that from the possession of the applicant the Brown Sugar was recovered worth Rs.1,20,000/-. 5.

I have heard learned counsel for the parties and perused the case diary.

Considering the quantity of Brown Sugar which is less than commercial quantity and more than small quantity, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
