1. This is an application filed under section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant in connection with Crime No. 37/2015 registered at Police station Tumla, Distt. Jashpur (C.G) for the offences punishable under section 20-B of the Narcotic Drugs and Psychotropic Substances Act and Section 3/181, 146/196, 130(3), 177 of the Motor Vehicles Act.
2. As per the prosecution case, on 22.04.2015, the Police station Tumla has received secret information that some persons were traveling Maruti Suzku Alto carrying with narcotic substance with them . On such information, the police reached the spot and intercepted the car. On inspection of vehicle, 34 Kgs. of cannabis was recovered from the applicant and other co-accused. Accordingly, the offence was registered and the applicants were taken into custody.
3. Learned counsel for the applicant submits that the applicant has been
falsely implicated and no evidence is available against him in respect of recovery, therefore, he may be enlarged on bail.
4. A perusal of the case diary and statements would show that primafacie it has come on record that this applicant was carrying 34 Kgs., of cannabis in the car.
5. Taking into evidence, I am not inclined to allow the bail application. Accordingly it is dismissed.
