The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 165/2015 registered in Police Station Mana Camp, Raipur (C.G.) for offence punishable under Section 457, 380, 381, 34 of IPC.

As per the prosecution case, in between the intervening night of 67/09/2015 cash amount of Rs.1 lakh was stolen from M.M. Industries Pvt. Ltd. situated at Dumartarai and on the suspicion when enquiry was made present applicant was arrested. On the basis of memorandum statement of the applicant and other co-accused cash amount of Rs.95,040/- was recovered from different places.

Learned counsel for the applicant submits that charge sheet in this case has been filed and the applicant is in jail since 8/09/2015 and there is no directed evidence is available against this applicant, therefore he may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Having regard to the nature of allegation and the recovery made which is of the currency notes, taking into account gravity of the offence, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
