Versus

1. State of Chhattisgarh, Through Secretary, Department of Cooperation, D.K.S. Bhawan, Raipur, Chhattisgarh.

2. Chief Executive Officer, District Co-operative Central Bank Ltd. Raipur, Chhattisgarh.

---Respondents For Petitioner :- Mr. Akshay Uppal, Advocate For State :- Mr. Sunil Otwani, Addl. A.G.

For Respondent 2 :- Mr. Rajat Agrawal, Advocate Hon'ble Shri Justice Sanjay K. Agrawal Order on Board 27/09/2021

1. Heard learned counsel for the parties at length and perused the records.

2. By order dated 30/04/2013 passed in WPS No. 1245/2013, this Court directed respondent No. 2 to consider and dispose of petitioner's representation, which has been done by respondent

No. 2 vide impugned order dated 01/08/2013 (Annexure P/1).

3. A careful perusal of the impugned order (Annexure P/1) would show that nothing has been considered by the respondent No. 2 Bank while deciding petitioner's representation and it has simply been rejected by passing an unreasoned and nonspeaking order simply saying that petitioner is not entitled for any further benefit/arrears of salary. As such, the impugned order 01/08/2013 (Annexure P/1) is hereby set aside and matter is remitted to respondent No. 2 Bank for considering and deciding petitioner's representation afresh by passing a reasoned and speaking order within six weeks from the date of receipt of a copy of this order. Petitioner is at liberty to make additional representation within two weeks from today. It is made clear that this Court has not expressed any opinion on the merits of the matter.

4. In view of the aforesaid direction, this writ petition stands disposed of. No cost(s).
