The applicant has preferred this second bail application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is arrested in connection with Crime No.48/2019, registered at Police Station - Chandani, District Surajpur (C.G.) for the offence punishable under Section 302/34 IPC. 2.

First bail application of the applicant was dismissed on merit. 3.

Allegation against the applicant is that he along with co-accused person, on account of land dispute, committed murder of deceased Devsiya Sahu when she was grazing her cattle. 4.

Learned counsel for the applicant submits that some witnesses have been examined before the trial Court, out of which, two witnesses though stated against the appellant, but in crossexamination, they have not supported the version of the prosecution.

After dismissal of first bail application on merit, I do not find any change in circumstances.

Accordingly, the second bail application is dismissed. However, the trial Court is directed to conclude the trial as early as possible, preferably within a period of six months from the date of receipt of copy of this order, in accordance with law.
