The petitioner by way of this petition seeks to impugn the order dated 15.09.2016 passed by the Collector, Dantewada whereby punishment of stoppage of one annual increment of the petitioner with non cumulative effect has been ordered. The order impugned is appealable order under Section 23 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966.

In view of fact that the petitioner has efficacious statutory alternative remedy of appeal, the present petition is not maintainable.

Accordingly, the petition is dismissed as not maintainable. However, liberty is reserved in favour of the petitioner to challenge the impugned order by way of departmental appeal before the competent authority and thereafter to avail other remedy available to him under the provisions of law.
