NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CONT No. 102 of 2017 • Smt. Devki Kumar W/o Laxman Kumari, Aged About 25 Years R/o Subhash Nagar, Ward No.22, Police Station Mahasamund, District Mahasamund, Chhattisgarh ---- Petitioner

Versus

1. Neha Champawat Superintendent Of Police Mahasamund District Mahasamund, Chhattisgarh

2. Shiv Shankar Thakur, Station House Officer Police Station City Kotwali Mahasamund, Chhattisgarh ...............(Contemnors) ---- Respondents For Applicant:

Mr. Pawan Kesharwani, Advocate For State :

Mr. Ashish Shukla, Government Advocate and Mr. Sumeet Jhanwar, Panel Lawyer Hon'ble Shri Justice P. Sam Koshy Order on Board 17.02.2017

1. The present proceeding has been drawn with a prayer to initiate a contempt proceeding against Superintendent of Police, Mahasamund and also the Station House Officer, Police Station City Kotwali, Mahasamund.

2. We do not intend to take any contempt petition at this preliminary stage. This Court vide its order dated 15.07.2016 in Criminal Revision No. 643/2016 had made an observation that the only direction which this Court could issue to the Police Authorities was to conduct a proper investigation in accordance with law and take a suitable decision.

3. The grievance of the Petitioner is that inspite of the specific

direction the authorities have not proceeded any further in the F.I.R which was lodged on 21.08.2015 i.e. Crime No. 355/2015.

4. Today Shri Ashish Shukla, Government Advocate along with Shri Sumeet Jhanwar, Panel Lawyer for the State under oral instructions from the concerned Superintendent of Police submitted that investigation in the case is still in progress and very soon the authorities would take an appropriate decision in the light of the materials collected during the investigation.

5. We hope that the Police Authorities will definitely take prompt steps in this matter as the F.I.R. which has been lodged by the Police Authorities cannot be left unattended for years together only on the presumption that it is a case of political rivalry with which the F.I.R. has been lodged. Even if it be so the F.I.R. which has been registered has to reach to its logical conclusion.

6. In the light of the submission made by the Counsel for the State it is expected that the said authorities will take a prompt decision in the F.I.R.

7. With the aforesaid observation the present Contempt Petition stands disposed off.
