1. The defaults having already been removed, we have heard learned counsel for the applicant on I.A. No.1, application for condonation of delay in filing application seeking leave to appeal as also on admission.
2. On due consideration, application is allowed and delay of 140 days in filing the application seeking leave to appeal is condoned.

3. Accordingly, I.A. No.1 stands allowed.
4. Considering the statement of the prosecutrix and her birth certificate Exhibit A-1, showing her date of birth as 02.11.2004, we are inclined to grant leave to appeal.
5. Accordingly, Cr.M.P. is allowed.
6. Let regular acquittal appeal be registered and the same be posted for orders after two weeks.
