1. This is an application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 52 of 2015 registered at P.S. Special Police Establishment Unit, Bilaspur, Distt. Bilaspur (C.G) for the offence punishable under Sections 7, 13(1)(d) of Prevention of Corruption Act.

2. As per the prosecution version, the applicant who was a Food Inspector has made a demand of Rs.50,000/- from the complainant and he was caught red handed in the trap.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated to settle the personal vendetta as he has reported about the missing stock, for which, a show cause notice was also issued to the complainant and in order to combat that, the false reports were made. He further submits that the applicant is in jail since 10.09.2005 and prays for releasing him on bail.

4. Per contra, learned State Counsel opposes the bail

application.

5. I have gone through the case diary and other documents collected so far.

6. Having regard to the fact that the evidence has been recorded, the charge sheet has already been filed; the trial may take some time and looking to the pre-trial detention of this applicant, I am inclined to release the applicant on bail.

7. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. He is directed to appear before the said Court as and when directed by the said Court.
