State Counsel has filed an application for taking documents on record whereby they have shown that the police authorities have already submitted a closure report (khatma diary) No.35/2016 before the CJM, Raigarh on 2.8.2016 i.e. much after the filing of the present Petition. The State Counsel have also attached the documents Exhibit D-1 dated 3.8.2016 issued by the SHO, P.S. City Kotwali, District Raigarh.

In view of above, the closure report submitted by the police to the CJM, Raigarh, in the opinion of this Court, it would not be proper to go into the merits of the case at this juncture and the Petition thus has become

infructuous.

Accordingly, the instant Cr.M.P is dismissed as having become infructuous.
