1. Learned counsel for the petitioner would submit that notice under Section 40 (1) of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (hereinafter called as "the Act of 1993") has been issued against the petitioner in which he has appeared and filed the reply, but still no enquiry has been held and final decision has not been taken.

2. Be that as it may, the Sub-Divisional Officer (Revenue), Sakti is directed to proceed in accordance with law after following the provisions contained in Section 40 of the Act of 1993.

3. With the aforesaid observation, the writ petition finally stands disposed of. However, the petitioner is at liberty to file additional reply, if any. No cost(s).
