1. Heard.

2. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 28.07.2021 in connection with Crime No.156/2021 registered at Police Station Police Chowki Latori, P.S. Jainagar, District Surajpur (CG) for the offence punishable under Sections 363, 366 (A), 376 of Indian Penal Code and Sections 4 & 6 of Prevention of Children from Sexual Offences Act, 2012.

3. As per the prosecution case, on 21.07.2021 the prosecutrix who is a minor, enticed away from the lawful guardianship of her parents, thereafter, the applicant committed sexual intercourse.

4. Learned counsel for the applicant submits that the prosecutrix and the applicant were in love affair and the prosecutrix was in company of the applicant for few days. She would further submit that the prosecutix was major as on date as she was a student of Class-12th and presumption would be that she might have attained the age of majority. She would further submit that under the circumstances, at this stage the prosecution may be directed to expedite the trial.

5. Having considered the prayer, the Court below is directed to expedite the trial within a period of three months from today. It is also made clear that this Court has not observed anything on the merits of this case.
