1. Heard.

2. Learned counsel for the respondents submits that the contempt has been purged by granting appointment to the petitioner.

3. Shri Ajay Shrivastava, learned counsel for the applicant submits that the appointment has been made effective from the date of Order whereas the applicant was entitled for appointment from the date of retirement of his father.

4. In the opinion of this Court, whether the applicant is entitled to be appointed from the date of retirement of his father or from the date of appointment Order, is a separate issue for which the applicant is required to maintain a fresh petition.

5. The contempt petition is disposed of with liberty to the petitioner to maintain a fresh writ petition, as mentioned above. SD/- (Prashant Kumar Mishra) Judge Amardeep
