Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 22/08/2017 The relief sought in this petition is with regard to payment of gratuity. It appears that the gratuity of the petitioner earlier withheld because of an order of penalty which was subject matter of challenge in WPS No.739/2013. 2.

As the basis for withholding gratuity was recovery to be made against the petitioner in an order of department enquiry which has now been held to be illegal by this Court vide an order passed today in WPS No.739/2013, the very foundation for withholding gratuity goes. Therefore, the amount of gratuity is directed to be released to the petitioner forthwith in accordance with rules. 3.
