This is second bail application filed under Section 439 of the Code of Criminal Procedure, 1973 by the applicant for grant of regular bail, who has been arrested on 30.11.2017 in connection with Crime No. 360/2017 registered at Police Station- Ratanpur, DistrictBilaspur (C.G.), for the offence punishable under Section 302 of IPC.

The first bail application filed by the applicant was dismissed for want of prosecution on 29.06.2018.

Learned counsel for the applicant seeks permission of this Court to withdraw the instant bail application with liberty to repeat the same after examination of material witnesses.

Accordingly, the bail application is dismissed as withdrawn with the aforesaid liberty.
